Terms and Conditions of Website Use

The owner of the website https://fanuci-falcon.com is Fanuci & Falcon Global Group (hereinafter referred to as: F&F).

By searching for and accessing the F&F website, the user declares and confirms that they have read the content and accept these Terms and conditions of website use. This acceptance does not require the user to take any additional actions or express separate consent.

1. The content of the F&F website consists of various materials, including: logos/graphic signs, texts, messages, images, photographs, audio or video materials, as well as the design/layout of the website content (web design) and its software.
2. The intellectual property rights to the website and all its contents belong to F&F and as such are protected by general legal principles and national and international legislation on the protection of intellectual property, copyright and related rights, as well as computer crime law.
3. The website and its contents (i.e., logos/graphic signs, texts, messages, images, photographs, audio or video materials, and the design/layout of the website content [web design] and its software), as well as any live broadcasts transmitted on the site - especially from technology presentations, may not be copied, modified or distributed, unless F&F gives explicit consent in response to a prior written request from the interested party.
4. Copying, modifying, reproducing, displaying, distributing, transmitting or using the website content in any form and for any purpose (even for non-commercial purposes), without the express prior consent of F&F, is strictly prohibited.
5. Copying, modifying, reproducing, displaying, distributing, transmitting or using the website content after obtaining explicit written authorization requires the requesting entity to identify and indicate the source, that is: "Fanuci & Falcon" or "Fanuci & Falcon Global Group"
6. F&F reserves the right to take legal action against persons who engage in any unauthorized copying, reproduction, distribution, and commercial or any other improper use of the site and its content. F&F is not responsible for any misuse of the website by third parties/entities.
7. The content available on the F&F website is intended solely for promoting the technology within F&F's offer. The published content does not constitute a commercial offer within the meaning of the Civil Code.
8. F&F reserves the right to make changes and corrections, suspend, interrupt or close the website when it deems appropriate, without prior notification to users, for a period it deems necessary and for any reason, in particular without technical and administrative limits, and bears no responsibility for this.
9. It is strictly forbidden to share links placed on the F&F website on third-party websites.
10. The user of the F&F website undertakes: not to perform any activities that may interfere with its operation, not to attempt to access secured areas and content without proper authorization, and not to test, bypass or break installed security measures. Unauthorized use will be subject to penalties in accordance with applicable legal regulations.
11. In the case of using the website and its content (even if it is public content) in violation of the above Terms, the lack of reaction from the website owner cannot under any circumstances be considered as implied consent to non-compliance with these Terms.
12. For non-compliance with the Terms of website use, the user will be held liable in accordance with applicable civil and criminal law.
13. The above Terms and conditions of website use are governed by and interpreted in accordance with Polish law, whereby the user irrevocably accepts the jurisdiction of Polish courts to resolve any conflicts arising from and/or related to the Terms and conditions of use of the F&F website.

Terms and Conditions of Sale

• 1.General provisions
  • 1.1.These General Terms and Conditions of Sale (hereinafter referred to as "GTC") define the rules and conditions for the sale of FANUCI & FALCON devices by FANUCI & FALCON Global Group, hereinafter referred to as the "Seller", to customers, hereinafter referred to as the "Buyers".
  • 1.2.The GTC constitute an integral part of each sales agreement concluded between the Seller and the Buyer, unless the parties agree otherwise in writing.
  • 1.3.Special conditions individually agreed with the Buyer take precedence over the provisions of the GTC.
• 2.Offer and conclusion of the agreement
  • 2.1.All offers submitted by the Seller are informative and do not constitute an offer within the meaning of the Civil Code provisions.
  • 2.2.The sales agreement is concluded upon written confirmation of the order by the Seller.
  • 2.3.The Buyer is obliged to provide the Seller with complete and correct data necessary for the order fulfillment.
• 3.Product photos and visualizations
  • 3.1.Photos and visualizations of FANUCI & FALCON devices presented in offers and marketing materials are illustrative and may slightly differ from the actual appearance of production devices.
  • 3.2.The Seller reserves the right to make minor changes to the appearance of the devices that do not affect their functionality or technical parameters.
• 4.Price and payment terms
  • 4.1.Prices of FANUCI & FALCON devices are specified in the offer or order confirmation and are net prices, to which the applicable VAT tax should be added.
  • 4.2.The Buyer is obliged to pay the price under the conditions specified by the Seller.
  • 4.3.In case of payment delay, the Seller has the right to charge statutory interest for the delay.
• 5.Delivery
  • 5.1.The delivery date is specified in the order confirmation.
  • 5.2.The Seller reserves the right to partial delivery of the ordered devices.
  • 5.3.The risk of loss or damage to the devices transfers to the Buyer upon handing the goods to the carrier, unless the parties agree otherwise.
• 6.Receipt and complaints
  • 6.1.The Buyer is obliged to check the delivered devices immediately upon receipt.
  • 6.2.In case of defects, the Buyer is obliged to submit a written complaint before beginning the installation process.
  • 6.3.The Seller will process the complaint within 7 business days from the date of receipt.
• 7.Warranty and service
  • 7.1.The Seller provides a warranty for the sold FANUCI & FALCON devices for the period indicated in the warranty card.
  • 7.2.The warranty does not cover damage resulting from improper use, assembly, maintenance, or repairs carried out by unauthorized persons.
  • 7.3.All warranty repairs are performed by the Seller's authorized service center.
• 8.Liability
  • 8.1.The Seller is not liable for losses or damages resulting from the use of devices contrary to their intended purpose.
  • 8.2.The Seller's liability is limited to the value of the order fulfilled by the Buyer.
• 9.Force majeure
  • 9.1.The Seller is not responsible for non-performance or improper performance of the agreement due to force majeure, including in particular for losses caused by war, riots, natural disasters, strikes, etc.
  • 9.2.In case of force majeure, the Seller is obliged to immediately inform the Buyer about the situation.
• 10.Applicable law and dispute resolution
  • 10.1.The GTC and sales agreements are governed by the law.
  • 10.2.Any disputes arising from sales agreements will be resolved by the court having jurisdiction over the Seller's registered offices.
• 11.Final provisions
  • 11.1.Any changes to the GTC require written form to be valid.
  • 11.2.If any provision of the GTC proves to be invalid or ineffective, it does not affect the validity of the remaining provisions of the GTC.
  • 11.3.The GTC are effective from 21.08.2024 and replace all previous versions of the General Terms and Conditions of Sale.
